Abstract: The problem of convicting factually innocent persons is one of the
greatest problems of criminal law. Modern criminal procedure aims to reduce the risk of convicting innocent persons and to ensure the protection of their dignity, which as a goal is more important than the conviction of the guilty. Definitely, the protection of the innocent should be considered as a more important goal than the conviction of the guilty. The problem of convicting factually innocent persons is not only characteristic of plea bargaining, but it is also a necessary consequence of regular trials.

Keywords: criminal procedure, plea bargaining, guilty persons, innocent persons, verdict.
