Abstract: The free movement of people is one of the fundamental principles of the European Union and of every other country. The possibility for foreigners to live and work in any country, contributes to countries changing the way of organization and approach to foreigners. All in accordance with legal regulations and international agreements. In this paper, the term “foreigner” and the legal position of foreigners are defined initially. In the Republic of North Macedonia, the legal position of foreigners is legally defined by the Law on foreigners. This law will be applied in accordance with the international agreements that the Republic of North Macedonia has ratified in accordance with the Constitution, and which bring the foreigner to a more favorable position. In order to understand all the rights and obligations during the stay of foreigners, as well as positive and negative aspects of the Law on foreigners of the Republic of North Macedonia, a comparison will be made with part of the Law on the stay of foreigners in the Republic of Serbia.
