Abstract: The right of a citizen to be judged by an independent and impartial judge represents a guarantee by society that the judiciary fulfills the duty entrusted to it by the Constitution. It also ensures that this right is elevated to the highest level through its guarantee and consistent application of the Universal Declaration of Human Rights, as well as all other documents of the Council of Europe. The fundamental prerequisite for any society aiming to be a democratic society governed by the rule of law is the independence of the judiciary. The efficiency of the courts, legality in their procedures, prevention of rights abuse, and the completion of judicial proceedings within a reasonable timeframe, as stipulated by the Law on Civil Procedure, are essential for achieving the desired level of judicial independence. As a small contribution in this direction, this topic addresses the Procedure for the Recusal of Judges, with a particular focus on the reasons that may justify a judge’s recusal and the consequences that may arise from violations of the rules governing recusal.
