Abstract: The form of marriage is a part of the marriage law that regulates marriage and marital relationships. In marriages with a foreign element, the form of marriage is regulated by private international law. The form of the marriage is among the most important elements through which is trying to provide the marriage with appropriate dignity, but also legal certainty. The issues related to the requirements for the form of the marriage prescribed in the private international law and the differences that appear in comparative law, as well as the solutions found in our positive law, will be the subject of consideration in this paper.
